http://www.cak.cz/The method of determining the remuneration for legal services is primarily a matter of agreement between a lawyer and a client. We strive for the resulting remuneration to be the result of consensus between the parties, taking into account the complexity and scope of the legal services provided and the benefits that legal aid has given to the client.

Contractual remuneration is usually determined using the following methods:

  • the remuneration determined by the share in the value of the thing or the outcome of the thing,
  • reward according to the number of hours or other time units (time reward),
  • remuneration according to the number of legal aid actions performed in the case,
  • flat fee for long-term legal advice,
  • possibly also as a combination of the above methods.

If the remuneration is not agreed, the lawyer is entitled to the so-called non-contractual reward, the amount of which is determined to be deducted. No. 177/1996 Coll., as amended (so-called advocacy tariff).

If the representation in civil litigation ends with success, the costs of legal representation may be wholly or partly compensated by the award of damages to the counterparty, the amount of which is determined by the court according to the law. No. 177/1996 Coll., as amended (this amount does not need to cover the remuneration of a lawyer who has been separately negotiated between a lawyer and a client)
